The Data Controller processes personal data that you provide or personal data obtained during the fulfilment of your order. 

The data processed includes identification and contact details, as well as other data necessary for the performance of the contract.

 

3. Legal Basis and Purpose of Personal Data Processing

 

3.1 Legal Basis for Processing Personal Data:

a) Performance of the contract between you and the Data Controller, based on § 13 para. 1 letter b) of the Law on Protection of Personal Data. 

b) Legitimate interest of the Data Controller to send direct marketing communications (including business announcements and newsletters), based on § 13 para. 1 letter f) of the Law on Protection of Personal Data. 

c) Your consent to process personal data for the purpose of providing direct marketing (including business announcements and newsletters), based on § 13 para. 1 letter a) of the Law on Protection of Personal Data (if no order of goods or services has been placed).

 

3.2 Purpose of Personal Data Processing:

a) Processing your order and fulfilling rights and obligations arising from the contractual relationship between you and the Data Controller. Personal data such as name, address, and contact information are necessary to process the order. Without providing this data, we cannot conclude or perform the contract. 

b) Sending business announcements and engaging in other marketing activities.

 

3.3 Automated Decision Making:

The Data Controller makes automated individual decisions based on § 28 of the Law on Protection of Personal Data. You have provided explicit consent for such processing.

 

4. Legal Basis for the Processing of Personal Data:

 

a) Article 6(1)(b) of the GDPR: Processing of personal data is necessary for the performance of the contract, where the buyer is the contracting party, or for taking steps at the request of the buyer before entering into the contract. 

b) The Data Controller notifies the buyer that, based on Article 6(1)(b) of the GDPR, personal data will be processed in the course of concluding a purchase contract, without the need for consent, as part of pre-contractual relations and contract fulfilment. 

c) Article 6(1)(c) of the GDPR: Processing of personal data is necessary to fulfil legal obligations. 

d) The Data Controller notifies the buyer that, based on Article 6(1)(c) of the GDPR, personal data will be processed to fulfil legal obligations, such as tax obligations, without the need for consent.

- Persons involved in the supply of goods/services and execution of payments under the contract. 

- Persons providing e-shop operation services and other services related to the operation of the e-shop. 

- Persons providing marketing services.

  - Public regulatory bodies (e.g., Slovak Trade Inspection, Office for the Protection of Personal Data)

6. Retention Period of Personal Data

 

Personal data will be retained for the period necessary to fulfil the legal and contractual obligations arising from the concluded purchase contract. For example, according to § 599 para. 1 of the Civil Code, the buyer can assert rights related to defects in goods within 24 months of receiving the goods. 

Personal data may be retained for longer periods if required for archiving accounting documents according to specific regulations. 

For marketing purposes, personal data will be processed until consent is revoked, but for no longer than 10 years.

 

7. Rights of the Buyer

 

The buyer has the right to: 

- Access their personal data. 

- Correct personal data. 

- Request the deletion or restriction of processing of personal data. 

- Object to the processing of personal data. 

- Exercise the right to data portability. 

- File a complaint with the relevant supervisory authority

 

8. Legal or Contractual Requirement

 

The buyer is obliged to provide personal data for the purposes stated in these terms. Failure to do so may prevent the conclusion of the purchase contract or the fulfilment of the rights and obligations arising from the contract.
